亞馬遜Generic也侵權？厲害了，Word哥!

選擇了做亞馬遜，寄生在第三方平臺上經營，就注定你不可能一直高枕無憂，隨時都可能有戰情，比如，這個春節，就讓一些賣家過得很郁悶。

原本賣的好好的產品，或跟賣或自建，經過多方面評估加經驗判定不侵權的命名為Generic的產品，突然之間收到平臺的郵件通知，輕則產品被移除，更多的卻是直接被移除銷售權限。

事件首先是從亞馬遜加拿大站點爆發的，緊接著就蔓延到美國站，很多賣家都覺得躺槍了，可是也無計可施，只能誠恐誠惶的寫申訴郵件，但收到的回復多是系統自動回復的郵件模板。

下面是某賣家收到的被移除銷售權限的通知：

Hello,

You currently may not sell on Amazon.ca because you are offering items that may infringe intellectual property rights or may be inauthentic. Examples of these items are at the end of this email.

Funds will not be transferred to you but will stay in your account while we work with you to address this issue. If you have any open orders, please ship them.

You can see your balance and settlement information in the Payments section of Seller Central. If you have questions about those, please write to payments-investigate@amazon.ca.

To sell on Amazon.ca again, please send the following information to pq-review@amazon.ca:

-- Copies of invoices, receipts, contracts, delivery orders, or authorization letters from your supplier issued in the last 90 days. The quantity of items shown should match your inventory.

-- If you are not the brand owner, provide an authorization letter and a complete set of documentation, including authorization letters, to prove a valid supply chain.

-- If you are the brand owner, provide a copy of the brand registration certificate, and business license or personal identity card.

-- Any additional details you would like us to know.

You can send .pdf, .jpg, .png, or .gif files. These documents must be authentic and unaltered. You may remove pricing information, but the rest of the document must be visible. We will maintain the confidentiality of your supplier contact information.

We will review your information and decide if you may sell on Amazon.ca again. If you do not send the required information within 17 days, we may not allow you to sell on Amazon.ca.

在通知的結尾處，亞馬遜舉例了侵權的商品，而這些產品被列舉出來的原因，都是因為產品發布時在Brand處填寫了Generic。

我們知道在發布產品時，Brand Name是一個必填項，Amazon也規定對于沒有品牌的產品，一律填寫Generic。所以很多賣家這么做了，但如今卻遭到因為使用Generic而成了侵權產品，著實讓人很無語。

我們知道Generic在英文中的本意是“通用的、不注冊的、非專利的”意思，但如果去美國商標局網站上查詢，你同樣可以發現Generic又是一個被注冊的商標。當一個原本具有通用意思的詞語成為商標，如果商標持有人去投訴，我們不知道亞馬遜會對此做出如何的判定，但問題畢竟已經爆發出來了。

帶著這個問題，我在Amazon美國站首頁用Generic來搜索，截止到目前為止，依然可以獲得170多萬個搜索結果，可見如果一刀切全部下架和移除賬號銷售權限，肯定波及到太多的賬號的。

針對當前的這種情況，我估計亞馬遜應該會和其他商標做區別對待的，畢竟之所有有這么多賣家如此發布，也是系統在發布時的提醒導致的。但不管怎么說，如果賬號已經遭遇了這樣的情況，申訴還是必須的，那么具體該怎么申訴呢?首先一定要誠懇的表明自己是一個誠信的賣家，沒有有意侵權別人的意思，同時，有相應的采購單據發票的，也一定要積極提供，能多全面就多全面，在此之外，還要在郵件中著重強調，之所以使用Generic填寫在Brand Name處，是因為系統的提醒，是按照亞馬遜的規章要求操作的，最后還要懇請亞馬遜能夠給一次機會，自己將立即對店鋪做出整改等等。

對于當前有Generic產品在線但尚未收到通知的賣家，我建議最好是能夠對Listing進行編輯或者刪除，能夠編輯品牌名稱的，果斷編輯修改，不能夠編輯品牌名稱的，果斷刪除，也許有些賣家會說，我還有不少產品在庫存，對于這個狀況，我只能說，你自己要對比一下，是匆忙的銷售一些產品然后導致賬號死掉劃算，還是損失一點庫存，增加一點成本，保護賬號安全劃算。

注意我這里說的刪除(Delete),而不是關閉(Close)。刪除意味著這條Listing在亞馬遜數據庫中消失，而關閉意味著該Listing的數據依然記錄在亞馬遜中的數據庫中，只是在前臺不可見，之前曾經發生過不少賣家因為侵權產品僅僅Closed掉，很長時間后，自己已經忘記了的情況下卻導致賬號突然受限的情況。

不管怎么說，依托于第三方平臺進行銷售，就意味著我們需要不停的面對新情況解決新問題的過程，當前我們尚無法判定此事件的最終處理結果，但不可否認的是，這次事件再次給賣家敲響警鐘，在亞馬遜平臺上，沒有商標的裸泳不行了，打算長期做下去的賣家，也確實需要快速行動起來，注冊自己的商標，做好應有的保護，在安全的基礎上，精耕細作才是上策。
